15.01.010 Special definitions.

“Applicant” means the person in whose name the application is filed or a co-applicant. In the event that the application is filed in the name of a corporation, association, partnership, or d/b/a, then the name of any real party at interest shall be indicated as a co-applicant.
“Real party at interest” means: (a) the person, including a corporation, holding a majority interest in the applicant; (b) a person who is a member of a group of people holding a majority interest in an applicant who are related as children, parents, or spouses; (c) any other business entity operating in the city which is at least half owned by a real party at interest. The building official may require identification of the applicant on a verified form. (Ord. 691 §1, 1999)

15.01.020 Sales tax compliance certification.

No permit shall be issued if the property owner or contractor is delinquent in the payment of any sales tax of the city or borough. Before issuing a permit, the building official shall receive a tax compliance certificate completed by a representative of the borough finance department which certifies that the property owner and contractor are in compliance with all borough sales tax provisions. 15.01.030 Fee Collection.

Wherever in this code the “Building Official” is designated as the collector of fees, this shall be changed to read the “city treasurer.” The city treasurer shall keep a permanent, accurate record of all fees and other monies collected and received under this code, the names of the persons upon whose account the same were paid, the date and amount thereof, together with the location of the building or premises to which they relate. 15.01.040 Board of Appeals.

In order to hear and decide appeals of orders, decisions, or determinations made by the building official relative to application and interpretation of this code, there shall be and is hereby created a board of appeals. That board of appeals shall be made up of the City Council. The building official shall be an ex-officio member of the board of appeals, but shall have no vote on any matter before the board. The Board shall operate under the rules of procedure established under SMC 2.04.020 and shall render its decisions and findings in writing to the appellant with a duplicate copy to the building official.
