10.56.010 Designated parking space for handicapped.

No person shall park, load, unload, or stand in any parking space designated for handicapped persons on public or private property unless that person is handicapped or unless the handicapped person is a passenger in the vehicle and unless the vehicle has a Wyoming portable-type handicap logo displayed on the dashboard or suspended from the rearview mirror inside the vehicle. The city is authorized to honor handicap stickers issued by other agencies which have the same or similar qualifications required by the Wyoming Department of Revenue. (2001 In-house code § 28-273)

10.56.020 Obstruction of handicapped parking spaces.

At no time shall handicapped spaces on public or private property be used for the storage of snow, trash, shopping carts, construction materials, or otherwise obstructed except when provisions have been made for additional, equally accessible, temporary handicapped parking spaces at least equal in number to the obstructed spaces. 10.56.030 Requirement of handicapped parking.

A. If parking spaces are provided for visitors or customers, except for private residences, handicapped only spaces shall be provided in the following ratio:
1. 10—50 spaces: one handicapped space.
2. 51—100 spaces: two handicapped spaces.
3. Greater than 100 spaces: two plus one percent of total spaces over one hundred (100) handicapped spaces.
B. All fractions in the ratios designated in subsection A of this section shall be rounded up.
C. All designated handicapped parking spaces shall be marked with a sign mounted on a substantial post or standard permanently fixed to or imbedded into the parking surface with the international symbol of accessibility, and the words “Handicapped Parking Only,” or “Reserved Parking Only.”
D. All designated handicapped parking spaces shall be a minimum of twelve (12) feet by twenty (20) feet in size except for those in parallel areas of the city streets, the size of which shall be determined by the city traffic engineer.
E. All designated handicapped parking spaces shall be those parking spaces located nearest the main entrance of the building(s) served by the parking area.
F. In the event that a designated handicapped space is regularly occupied by (an) employee(s) in a parking area used by the public, additional designated handicapped spaces shall be provided in a number equal to the number of spaces occupied by employee(s).
G. The provisions of this section shall be applicable to new parking areas upon the publication of the ordinance from which this section derived. The provisions of this section shall apply to existing public or private parking areas two years after publication of the ordinance from which this section was derived. (2001 In-house code § 28-276)

10.56.040 Handicapped parking penalties.

Any person found guilty of violating Sections 10.56.010 and 10.56.020 shall be fined not less than fifty dollars ($50.00). (2001 In-house code § 28-317.1)

10.56.050 Restriction on residential handicap parking space use.

All applications for a residential handicapped parking space and all requests for renewal shall be submitted to the city traffic engineer on forms provided. (2001 In-house code § 28-350)

10.56.060 Permit fee—Payment.

The fee for a handicapped parking space shall be five dollars ($5.00) per year. The fee shall accompany the initial application and each year’s renewal application. (2001 In-house code § 28-351)

10.56.070 Permit—Duration.

A handicapped parking space permit shall be valid only until December 31st of the year of issue. (2001 In-house code § 28-352)

10.56.080 Permit renewal.

Applications for renewal shall be made during November and December of each year. If a request for renewal has not been received by the city traffic engineer by December 31st, the city traffic engineer shall immediately proceed to remove the handicapped parking space signs in question. 10.56.090 Permit issuance.

All applications for a handicapped parking space permit and requests for renewal shall be submitted to the mayor’s council for people with disabilities for its investigation and recommendation. After due consideration, the mayor’s council for people with disabilities shall submit its recommendations for approval or disapproval to the mayor who shall have the authority to approve or disapprove all applications and all requests for renewal pursuant to the provisions set forth in this chapter. 10.56.100 Installation cost--Payment.

By November 1st of each year the city traffic engineer shall determine, as accurately as possible, the cost of installing the handicapped parking space signs for the coming calendar year. Each applicant shall pay the cost of the installation after approval of his or her application but before the installation occurs. (2001 In-house code § 28-355)

10.56.110 Minimum requirement.

No application shall be approved or issued unless the following requirements are met:
A. The property or premises of the applicant in question is located on a street in the city which qualifies, under appropriate regulations, for handicapped parking;
B. The applicant has obtained a handicapped sticker from the Wyoming Department of Revenue. (2001 In-house code § 28-356)

10.56.120 Signing.

Each handicapped parking space shall be designated by two official handicapped parking signs. All signs designating residential handicapped parking spaces shall have the words “Handicapped Applicant Parking Only” printed on them. (2001 In-house code § 28-357)

10.56.130 Restriction on residential handicap parking space use.

A. The use of each residential handicapped parking space established under the provisions of this chapter shall be restricted solely to the applicant who obtained the space designation.
B. It is unlawful for any person other than the applicant to park in a residential handicapped parking space. (2001 In-house code § 28-358)
